Medford, Ore. —   " A well-known businessman is sentenced to a month in jail for assaulting a local NBC Dateline producer. It’s a story NBC5 has been covering since the incident occurred in June.

Louis Mahar of “Mahar Brothers Construction” pleaded no contest Friday to charges of assault and harassment. Mahar was charged with misdemeanor assault and two counts of harassment for harassing Anna Bishop at a party, and then assaulting her husband Shane Bishop, resulting in serious injuries.

In court Friday, Mahar briefly apologized. Bishop says he’s glad the case is behind them.

“I have never physically hurt anyone in my life,” Louis Mahar read in court, “I hope the court can show some leniency in my sentence on count 1.”

“We’re very grateful to the Jackson County Sheriff’s Office and the Jackson County District Attorney’s Office for their commitment to pursing the truth, and we’re glad this is finally over,” Shane Bishop told NBC5 after the sentencing.

Mahar is scheduled to report for jail on January 3rd, 2017 but he is eligible to apply for home detention. In addition to his jail sentence, Mahar will serve 2 years probation. The Bishop’s are seeking several thousand dollars in restitution"

Four family members plus a neighbor said in their lawsuits the balcony detached from the main building and collapsed in September, causing a host of injuries that included a concussion, herniated disk and a hand pierced by a nail. Medford Fire & Rescue responded to the collapse. A fire marshal noted dry rot and a low number of nails used in the balcony's construction.

The lawsuits allege the parties being sued were warned the balcony was unstable and was deteriorating but failed to repair or replace the balcony.

A Jackson County Circuit Court judge ruled this week the separate cases should be consolidated.

Tracy McGovern, attorney for the defendants, argued in a court submission that the lawsuits relate to the same incident and therefore should be consolidated.

Without consolidation, she wrote that the plaintiffs "would essentially get five 'separate bites at the liability apple' against Defendants. Defendants should only be required to defend liability once."

A consultant for the other side argued against consolidating the cases, saying jurors would be confused by complex medical information about all five injured people. The consultant also said jurors could award a smaller total amount if they feel sorry for the people being sued.

The lawsuits seek damages against Kathryn and Louis Mahar, Mary and Robert Niccolls and Oak Tree Realtors.

The Louis Mahar named in the lawsuits is an elder member of the Mahar family, not the younger Louis Mahar, who recently entered no contest pleas to assault and harassment charges after injuring a man during a graduation party

Whittle Construction contracting license suspended, leaving families with unfinished homes

 MEDFORD -- A Medford construction company got its contracting license suspended on Wednesday.

The state Construction Contractor Board said Whittle Construction Inc. will not be operating, after ten claims were filed against the company since December. These enforcement actions come from both homeowners and suppliers.

"It's pretty unusual when you have 36,000 contractors and one contractor ends up in a position like this. I don't know what their issue is or what's happening," said enforcement director Stan Jessup.

Whittle will have to come up with $100,000 in insurance to operate again. The CCB said the owner is not financially able to do so at this time.

For Richard Murdock, building a dream house has become a one-man production. The 75-year-old is finishing the work himself after Whittle Construction Inc. pulled out of the project in January.

"Here we were with a house that was maybe 50 percent done and he had all the money and wouldn't give any back," Murdock said.

The final bill to Whittle was $342,000. Since then Murdock has put $150,000 into uncovered lien costs left by the contractor, and the remaining construction costs. But Patricia Hoefer said her concern is having a retired husband finish the job.

"He was having cramps in his legs and everything because he worked so hard and was lifting so hard and trying to do all the work himself," Hoefer said.

Whittle Construction Inc. told News10 in a statement that they are experiencing financial difficulties and making every effort to assist in the completion of homes under construction. They remain optimistic that customers will be satisfied with the end result.

The couple continues to keep a positive mindset on the house, and a watchful eye on their finances.

"We hope we have enough money left. Even probably for our funeral or something because of all of this that's going out. We talked it over and we decided we would go with finishing the house," Hoefer said.

But the two agree, this has changed their plans for retirement.

"We had money put away, things we were going to do when the house was done. We were going to take a nice vacation and maybe get Patricia out of her 2007 car into something newer...and those things aren't there anymore," Murdock said.

Whittle planned to finish construction last November. Murdock said he'll finish his own house this summer.

 MEDFORD -- Sheana Wilkinson signed papers with Whittle Construction last February.

Almost one year later, the owner told her in January he would not be able to finish the house. Wilkinson said she had saved for 13 years, and lost almost $250,000 in deposits. Soon after, her family became responsible for the construction company's loan of $200,000.

"We were contacted by the bank in January that if we didn't assume the loan that our home was going to be foreclosed on. So in desperation to save the house we signed the papers," said Wilkinson.

 The homeowner began working with an attorney after police told her they would not be able to help.

"He said that it's a civil matter so that has to be resolved through circuit court which just means attorney fees for us and we're already more than $10,000 in attorney fees just fighting for the position that we're at right now," said Wilkinson.

Right next door, Steve O'Neill is involved in a lawsuit with the construction company. O'Neill said this follows the owner not properly measuring the property boundary line.

"This is a guy that had professionally built hundreds of houses. And to be so off... not just inches but four, five, six feet on varying parts of the boundary... it's ridiculous," said Steve O'Neill.

Wilkinson said she's saving her attorney costs to fight more than $80,000 in lien fees.

"One subcontractor has already started the foreclosure process on us. We got another intent for foreclosure from another subcontractor. And it's like...I understand that we all lost something. But they're trying to take my home away from me," she said.
