 Oregon Defense Contractor Target of Investigation

GRANTS PASS, Ore. (AP) – Federal authorities are investigating whether a U.S. Army Corps of Engineers program manager made sure an Oregon defense contractor won nearly $160 million worth of contracts as part of a cozy relationship that included snowboarding and fishing vacations, trips to Singapore and Bali, and sex with female employees hired to work with him.

Affidavits filed in U.S. District Court in Eugene outline findings and witness statements that allege Jerry Hodgson, a program manager for the corps in Omaha, Neb., rigged bids on eight contracts dating back to 2004 for Sky Research Inc. of Ashland. The company specializes in aerial surveys of old military bombing and gunnery ranges to find old weapons debris.

No charges have been filed.

Assistant U.S. Attorney Sean B. Hoar said the investigation is ongoing.

“We take seriously our role as a financial steward of the public’s money and the trust that is put into us,” said corps Omaha District Assistant Special Counsel Tom Tracy. “We are looking into the allegations, and taking them seriously.”

An attorney for Hodgson said the allegations against his client were unfounded.

“Mr. Hodgson has enjoyed a long and distinguished career with the Omaha District of the Army Corps of Engineers,” his attorney Andrew D. Strotman said in an email. “These allegations are unfounded and inaccurately portray the contracting practices of both Mr. Hodgson and the Omaha District.”

Attorneys for Sky Research owners Sky (his singular legal name) and his wife, Anne Sky, did not immediately return calls for comment. An attorney for Sky Research issued a statement denying the allegations.

“Although the company has not had much time to examine the information released last week, it appears that the accusation against it is the product of rumor and speculation,” Douglass H. Schmor said in a statement. “The company is finally in a position to gather evidence and other information about the accusation and is confident that it will be able to rebut it.”

The investigation was first reported by the Eugene Register-Guard.

Based on the affidavits, U.S. District Magistrate Judge Thomas Coffin in Eugene authorized search warrants that seized computers and records from offices of Sky Research in Oregon and Colorado and the homes of Sky and his wife, as well as Hodgson’s personal email account, according to court records unsealed last week.

The investigation focused on potential charges of bribery of a public official, conspiracy to defraud the United States, wire fraud, padding bids and bid rigging, affidavits said.

U.S. Army Special Agent Derek W. Lindbom wrote that the investigation was sparked by a confidential informant who contacted the Army’s inspector general in 2010 with allegations that Hodgson returned bids to Sky Research with instructions on how to change them so they would be sure to win a contract, that Sky Research hired personal assistants to work just with him, and that Hodgson arranged for their salaries to be billed to the government.

The informant also alleged that the Skys billed the government for a vacation to Singapore and Bali, listing it as a marketing cost, Hodgson arranged for them to be paid advances for work not yet finished to carry them through slow periods, the Skys arranged for cars to be sold below cost to Hodgson, and bought an airplane from Hodgson’s son, which was upgraded at government expense.

When an investigator interviewed Hodgson, he admitted taking his kids on annual snowboarding vacations with Sky and his kids, and considered Sky a good friend, the affidavits said. Shown invoices for a fishing trip to Alaska paid for by Sky, Hodgson said he paid him back in cash, but couldn’t recall which account he had withdrawn the money from.

Hodgson also acknowledged having a romantic relationship with one woman who worked at Sky Research, which included sex, and having sex with two others, an affidavit said. One former Sky Research program manager said she was fired after refusing to have sex with Hodgson.

Hodgson denied statements from women who worked at Sky Research that he sat in on hiring interviews for women who would be working with him.

Hodgson told investigators he first met Sky in 1997 or 1998 when working on a project at the former Lowry Bombing and Gunnery Range outside Denver.

Sky Research has an office in the Denver suburb of Englewood and a residence in Centennial, Colo., where employees told investigators that Hodgson was a frequent guest who was lavishly wined and dined because he was responsible for all the company’s contracts.

The affidavit includes excerpts from emails indicating Hodgson told Sky Research how to massage bids to be sure to win a contract, and offered to pad contracts with extra money.

“Based on discussions with afcee (Air Force Center for Engineering and Environment) today I think this will get funded – to whatever level I decide is appropriate,” read one from Hodgson to a Sky Research employee. “So we’ll want a scope put together (draft for me to massage) and an estimate (detailed) as we need it ready to go – timing is the key, plan is to capture monies I send back on other projects … can’t let it sit or someone else will grab it – that’s why we need a “firm” cost/number. This is a huge deal for us and will put us so far ahead of everyone else doing this.”

Former Sky Research project manager Andrew Biaggi told Lindbom that on a contract for work at Dyess Air Force Base outside Abilene, Texas, Hodgson told him to bid on work for 50 acres, when the site was actually only half an acre.

Former Sky Research senior accountant Kimberly Walker told investigators she recalled one project in Puerto Rico had a profit of 400 percent. She said excess profits from one project were routinely used to cover cost overruns on another, a practice they referred to as “Jerrying.”

Cayla Vitko, who formerly worked in accounts payable for Sky Research, told investigators that when she questioned expenses related to Hodgson, “She was told they needed to keep Hodgson happy because they get all of their contracts from him,” an affidavit said."

" Federal prosecutors claim an Ashland research and development firm bribed a government official for help in acquiring nine U.S. Army Corps of Engineers contracts worth $171 million.
The claim was made Thursday in the first filing in federal court on the case in three years. Sky Research Inc.'s owner, who goes by the single name Sky, is scheduled to enter a plea at 11 a.m. Monday in U.S. District Court in Portland before Judge Marco A. Hernandez.
Federal prosecutors have been investigating Sky Research, whose headquarters are located near the Ashland airport, since 2010. In March 2012, federal agents seized thousands of payroll, tax and personal finance documents as well as digital data and other items from the company offices and the home of Sky and his wife, Anne Sky, in 1000 block of East Main Street.
Sky Research Inc. specializes in aerial mapping, geophysical surveys and remote sensing, and developed equipment for detecting unexploded material. The company's products were put to use in decommissioned military ranges and other areas that could harbor live munitions.
Prosecutors intend to seek a charge of conspiracy to defraud the United States against Sky Research Inc., also known as SRI, according to documents filed in U.S. District Court in Portland. They allege SRI bribed Jerry Hodgson, Corps program manager who oversaw the Department of Defense's Military Munitions Response Program in Omaha, Neb., with trips and other gifts over 11 years in exchange for steering $171 million worth of contracts to the company. SRI received $77 million total under the nine contracts, the latest court filing states.
The bribes included a car, an Alaskan fishing expedition, meals and accommodations in Costa Rica and Vietnam and $4,000 in cash, among other items, according to Thursday's filing. Affidavits filed in 2012 also allege the Skys provided Hodgson with three personal assistants over a span of eight years to fulfill sexual favors for him.
The earlier affidavits allege Hodgson's insider help on the company's bids was so well known that some employees used the term "Jerrying it" when referring to an upcoming contract the company intended to fix.
Sky could not be reached for comment. His wife, Anne Sky, told The Oregonian she could not comment when reached Thursday. She is listed as the company's vice president."

1. I am the attorney for the defendant who is 73 years of age and who
resides in the area of Medford, Oregon.
2. On April 18, 2006, Mr. Sky pleaded guilty to conspiring to give a
gratuity to a government employee in violation of 18 U.S.C. §201(c)
(l) (A). Sentencing is set for October 10, 2016.
3. A few days after he entered his plea, on April 23, 2006, Sky suffered a
severe stroke, as a result of which he was initially unable to walk, speak,
or understand others.
4. Sky entered the Asante Rogue Regional Medical Center on May 2, 2016,
and remained there for a month. He was discharged on June 3, 2016.
Since his discharge, he has been undergoing intensive rehabilitation. He
is gradually regaining his faculties and is making reasonable progress
towards rehabilitation.
5. I have forwarded to the government a copy of Mr. Skys hospital
discharge records. These records document his symptoms, treatment,
diagnosis and prognosis.
6. I recently spoke with Sky by telephone and find that he speaks slowly and
with difficulty and that he frequently mispronounces and slurs words. He does not fully comprehend complex sentences. His thought sequencing is
poor. I am advised he has difficulty moving his upper limbs and that he
needs constant monitoring and assistance in everyday activities.
7. I believe that at least an additional six months is needed before Sky will
capable of helping me prepare for sentencing. I also believe this time is
needed to ensure that Sky will be able to meaningfully participate in
sentencing proceedings.
8. I have communicated with AUSA Scott Bradford and advised him I
would be seeking a lengthy continuance of the sentencing. He said he
had no objection.
9. In the interests of justice, the court should grant the motion.

J.H., a public official for purposes
of 18  U.S.C. § 201, was a program manager for the
United States Army Corp of Engineers (USA CE), Omaha District, Omaha, Nebraska, and oversaw the Department of  Defense MMRP. J.H.s duties, among others, included managing USA CE projects, approving claims submitted by vendors under USA CE contacts, and recommending vendors to be awarded specific contracts.
As to Count One, beginning on or about 2002 and continuing through and including 2013,
in the District of Oregon and elsewhere, defendant Sky and others knowingly and willfully
conspired and agreed together and with each other to commit an offense against the United States,
that is to directly and indirectly give, offer, and promise anything
of value to a public official for and because of official acts performed and to be performed by such public official in violation of 18 U.S.C. § 201(c)(l)(A).
To carry out that conspiracy, defendant
Sky and others provided J.H. with various things of value for and because J.H. used his position as a public official to influence or steer the awarding of nine USACE contracts to SR1 that totaled approximately $171 million in value.
In total, SRI
received $77 million under the nine contracts. The things of value included, but were not limited to, cash, accommodations, meals, entertainment, a car, golf, and fishing.
In furtherance of the conspiracy and to effect the objects thereof, defendant Sky and others
committed one or more of the following overt acts, among others, in the District
of Oregon and elsewhere:
In or about April 2004, defendant Sky paid for J.H. 's accommodations and meals in
In or about September 24, 2004, SRI was awarded contract              W9128F-04-D-0030 for $3 million;
In or about March 2008, defendant Sky paid for J.H. 's accommodations and meals
Costa Rica;
In or about March 2008, defendant Sky paid J.H. $1000 in cash;
On or about July 22, 2009, defendant Sky paid J.H. $3,000 in cash;
On or about July 23, 2009, SRI was awarded Contract                     W9128F-09-D-0029 for $9 million
for environmental remediation services;
In or about September 2010, defendant Sky paid for an
Alaskan fishing expedition for J.H.;
In or about September 2010, SRI was awarded Contract             W9128F-l 0-D-0093 in the amount of
$9.9 million for military munitions response services; and
Between in or about December 20 I 0 through in or about March 2013, SRI received more than
$8.8 million under contract W9128F-10-D-0093.

Contractor Admits To Bribes For $171M In Army Work

Law360, Washington (April 18, 2016, 6:29 PM EDT) -- The owner of Sky Research Inc. pled guilty Monday in Oregon federal court to a charge that he bribed a U.S. Army contracting official to secure $171 million in contracts for work identifying and disposing of unexploded ordnance. 
The Ashland, Oregon-based company’s mononymous owner, 73-year-old Sky, pled guilty to one count of conspiracy to bribe a public official identified as J.H., a program manager in the U.S. Army Corps of Engineers' Military Munitions Response Program, in a plea hearing presided over by U.S. District Judge Mario A. Hernandez, according to the court docket.

He faces a maximum five-year prison sentence plus restitution and an up-to-$250,000 fine, but prosecutors have agreed to recommend a lower sentence in exchange for his guilty plea and acceptance of responsibility, they said in a plea agreement filed in the case. Sky is scheduled to be sentenced on Oct. 11 and will remain out on bond in the meantime, the docket said.

Counsel for Sky did not immediately respond to a request for comment Monday, and attempts to contact SRI for comment were unsuccessful.

The MMRP is a remediation program intended to help identify and respond to unexploded ordnance such as land mines, discarded munitions and related contaminants at former military ranges, and to address safety, health and environmental risks, according to the U.S. Department of Defense.

According to a brief criminal information filed Thursday, J.H., based in Omaha, Nebraska, was a program manager at the Corps, overseeing the MMRP. Among other responsibilities, he approved claims submitted by vendors and recommended vendors for specific contracts, the information said.

From 2002 through 2013, Sky and several unspecified other people gave J.H. cash, paid for accommodation, entertainment, meals, and golfing and fishing trips, and bought him a car, among other “things of value,” in an attempt to induce him to award MMRP contracts to SRI, which specializes in unexploded ordnance detection, prosecutors alleged.

J.H. steered nine contracts to SRI, worth around $171 million total, beginning with a March 2004 memorandum that recommended the company for a sole-source contract, which was awarded to SRI that September, according to the information. The company ultimately received $77 million under the contracts, prosecutors said.

While the criminal information does not provide J.H.’s full name, it likely refers to Jerry Hodgson, a former Corps official who in affidavits filed in the court in 2012 was said to be under investigation for allegedly taking bribes from SRI. It was not immediately clear Monday whether Hodgson had also been charged in relation to the alleged bribery scheme.

The related investigation had begun in September 2010 after the U.S. Army Criminal Investigation Command was tipped off about Hodgson by a confidential informant, who also claimed that the firm was engaging in illegal accounting, according to those affidavits.

U.S. Magistrate Judge Thomas M. Coffin signed off on search warrants as part of that investigation, and federal agents seized documents from Sky, his wife and SRI, according to multiple local media reports at the time.

The government is represented by Greg Nyhus, Billy J. Williams and Scott E. Bradford of the U.S. Attorney’s Office for the District of Oregon.

Sky is represented by Michael R. Levine of Levine & McHenry LLC.
